    Default What are the advertising rules?

    I'm a Realtor in California and I was wondering if anyone would know what the rules are as far as advertising with incentives goes? I've see advertising like

    "Buy or sell with me and get a donation in your name to the charity of your choice" type of thing.

    As far as incentives go, Can realtors advertise something like "Get a free trip to Mexico when you buy with me" type advertisment?

    Just curious because I saw an article today that was talking about different incentives some sellers are giving, including trips/cars/money and whatever else they can think of.

    Every state has it's own rules. However, I think the key to remember, when a transaction is involved, is FULL DISCLOSURE to all parties.

    Default Incentives

    I am interested to know more perspective about this idea. I belong to so many non-profit organizations and often get solicited for certain projects. Instead of giving them my donations up front I am thinking of proposing to them that I will donate a certain amount for every lead that the organization sends my way that will result to a sale or purchase of a property. Is their any ethical problems to this idea?

    Both your ideas need to be checked with your state board. Paying someone who is not a real estate agent for a referral can potentially cost you your license. They are good ideas, but you have to be very careful.

    I know in the Mortgage side I can't give money for referrals. That's a big no no and I can get into some serious trouble. I do however do a raffle drawing at open houses to get peoples contact information. I give away a few gift certificates for lunch/dinner at selected restaurants around town here. I spoke with my broker about it and I'm okay since I'm not saying "hey, get your loan from me and get a free meal" I"m simply doing it to gather contact information to try to add people to my database. But yes, check with the board or your broker before you decide on what you want to do.
