Is this appropriate?
[COLOR=black][FONT=Verdana]Called an agency that co booked they had a listing one of my investor clients were interested in. The other agent insisted she had to show us the property. When we arrived there she immediately gave my client one of her business cards. Theirs more that happened later that I know was unethical but I want to see how other pros feel about her first action. The broker I learned from would consider that inappropriate that

Hello Curtis-
Rules do vary from state to state - but in the state in which I operate - the listing agent in this case would be in major trouble should you decide to make a case out of it. I suspect she probably violated the operating rules in your state as well the second she offered a business card to your client. The card - in fact - is the evidence that she solicited your clients business knowing your client had representation. That is at the extreme end - but the rules regarding contact of a represented buyer buy a licensed salesperson - even in a showing such as yours - are very specific.
However - I suspect she was probably just trying to be as cooperative as possible - and in your opinion may have stepped over the line a time or two during your meeting.
As a suggestion - wait a day or two and see how you feel. If your still pretty steamed and really feel she was trying to poach your client - as a first step write her a letter explaining your position - with a copy to her broker and yours. If your broker is on your side (as he or she should be) - a call from your broker to the listing agents broker would be in order. In that call I would want to know specifically what the listing broker is going to do as a means of internal discipline.
I expect that this would be enough to send a clear message to your overly aggressive colleague. BACK OFF SISTER !!!

I would not wait to cool off, this is something you should discuss with your broker. Allowing this behavior or not reporting it is almost like you are condoning it or saying it is OK.
If this agent will do this to another licensed agent, what do you think they will do with a buyer or seller?
It is your duty to ensure only the best of the best, the most ethical and honest agent are your peers, since this is in the best interest of the public.

This is why I coach my buyers so when the listing agent opens their mouth it sounds like the devil speaking. Works every time.
I never could understand why some listing agents insist on being there during showings and it is always the same agents and they are never top producers.
I would not let this episode get in the way of my job. From what you said it sounds like the agent is a slime ball but you will have trouble getting anything done. Filing complaints will eat more of your time than it is worth.Last edited by Greg; 09-02-2009 at 06:14 AM.

Hey thx for the responses. I have been unable to locate oklahoma rules regarding this subject. We are in a rual area here i dont think any action would be helpful here but to avoid agents like her. My broker was ticked off when i told her. Since i have been told she has a history of poaching clients.
