To be qualify in loan modification one must have the capability to pay what they borrowed.To keep their family at home.

I Disagree!!
If you start with your lender, (Do you really think they care about you?) They care about the bottom line.
Put it this way, YOU, are going into negotiations with a multi billion dollar entities LOSS Mitigation department, full of high dollar attorneys, and asking them to "Do me a favor" and modify my loan, you're going to lose money on the deal, but just modify my loan and I promise to pay. Right!!
Bad Move. Hire a professional litigation firm that has an attorney ON YOUR SIDE of the table and let them walk the walk. They have dealt with people begging for help before, by the time YOU even get all the paperwork together to be presented CORRECTLY and have the #'s line up the way they NEED to in order to qualify you are foreclosed. DO NOT call your lender first, and then hire a professional as you will have already possibly blown it by showing your HAND and get denied, then what is the attorney to do? Trust me I see and hear about these horror stories everyday. Go straight to a professional, especially if your lender is B of A, and a few others.
