Question for CA. Realtors????????????
I am a new agent in the Los Angeles are and was discussing a scenario with another newer agent in my brokerage. The scenario is, I am representing the buyer and submit an offer on a property the offer in turn is accepted and escrow opens. Upon completion of the inspection a request for repair is submitted to the seller who refuses any repairs. From my understanding California is a non rebate state and therefore I would be unable to ask for cash back at closing. Finally my question is at this point would I resubmit an entire new purchase contract reflecting the lower price as a result of the repairs needed. Would I submit a counteroffer? or a purchase agreement addendum? Thanks in advance

Brad,
I am not a realtor, but have flipped 100+ homes in the Los Angeles area in the past few years.
Anyway, I have often given people cash back for repairs, so I don't think that there is a problem with that... as long as the lender will approve of it.
Also, you can get creative and ask for a 'Credit for Closing Costs' rather than for the repairs. The lender, and your Broker, may like that verbage better and the result is the same for your client.

I agree with Derik, the wording is really what it boils it down to. However, to address your question about how to re-write the contract or make an addendum, all you'll need to do is call your escrow officer and have them "amend" the escrow to reflect the new price or terms of the transaction. If you still don't understand what I mean, call your escrow officer and explain your problem. They'll walk you through the what you need to do, I hope this helps.
