    Default Seller Contingency

    I ratified a contract on my current home in June with a settlement date in October. My seller agent assured me that he put in the "seller must buy a home" contingency, but I found out today that he didn't. I am having issues with the timeliness of a short sale on the house I intend to buy and wanted to make sure I wouldn't be forced to sell in October so I checked the contract and found out that things aren't what they were supposed to be. On the MD residential contract of sale the buyers and I signed the page stating the addenda marked are made part of the contract. The "Seller's purchase of another property" box was checked indicating the acceptance of that addenda. BUT the "Addendum - Standard Clauses" form is not initialed next to "Seller's Purchase of another property."
    My question is...legally will I be forced to sell in October or not?

    You need to contact an attorney familiar with Maryland real estate law. From what you said it sounds like you will have to sell but only an attorney can answer the question for you after reviewing the actual contract.
