    Default Question on Quit Claim deed in Utah

    I purchased 10 acres of land on an owner contract from a Utah land corporation in 1979. It was paid off in 1987. Current value is approx. $4,500.

    When I went to sell it , I found out that a deceased relative of the original owner was listed on the title.

    Can I have the deceased persons executor sign a quit claim to free up the title? (If the executor is still living)

    If the executor is also deceased, is there another remedy that will not cost more than the value of the land?

    I don't know the exact answer to your question (I'm a Florida girl and not familiar with Utah laws!), but I suggest you contact a title insurance underwriting company and/or a lawyer (first, get a copy of the last title insurance policy written on the property). They will hopefully point you in the right direction! (And it could get messy figuring out who alive has the legal right to the property....... and tracking them down to get a signature!). If you work with a title place and offer them the deal, they should be willing to do the search for free (and with internet technology, they could probably track down the legal owner in an hour....). But the remedy may not be as easy...

    Sorry that's vague, but you really need to talk to title person in Utah who knows their stuff so that you make sure to avoid this legal mayhem in the future!
