    Post Land Trust

    My question is>>> If I put the land trust in my Corporation name, could I re finance it or get a new loan in the state of Texas?

    Default Refinancing through a Land Trust

    Hi Neil,

    It is going to depend on the lender more than anything. Many lenders will not lend to a trust of any kind, even if it is a Land Trust or Title Holding Trust. Other lenders require that the property be conveyed (deeded) out of the Land Trust or Title Holding Trust before they refinance the property and then allow you to convey it back into the Land Trust or Title Holding Trust once the refinance has been completed. You should shop lenders if you have time to find one that will allow you to finance and refinance property held in a Land Trust or Title Holding Trust without requiring you to convey out. This is important to maintain confidentiality and privacy of ownership through the Land Trust or Title Holding Trust.

    I also know that Texas has some quirky rules regarding refinancing and seconds and/or HELOCs. I know they have changed recently, but I'm not aware of what the changes are. Perhaps someone from Texas can chime in here?

    You are most welcome. The Title Holding Trust is a great solution to the confidentiality and privacy issue, but lenders always make it a little more tricky.
