    Default Resubdivision???

    Can someone tell me if there is a difference between sub-dividing a lot vs. re-subdividing a lot. Here is my situation: I own a home on Lot 1 with 3 acres. I also own an adjacent home I had built on Lot 2 which is one acre. The lots are connected, with a property line in between them. I would like to move most of the land from lot 1 over to lot 2, basically just moving the property line. No new lots will be created in doing this. My HOA says only that resubdividing a lot is prohibited. Can they stop me from doing this? Thanks for your responses!

    My first thought is YES they can stop you. My second thought is that you need to take this issue to a real estate attorney in your area. You may think it's not necessary, but the fee you pay the attorney to review this situation will be far less than if you try to proceed with your plans and get ordered to stop later into the project. A legal opinion is worth a lot more than any opinion you run across in a forum!
