early termination fee california
I currently am under a one year rental agreement and i am needing to break my lease early. Within my contract states " in the event of termination by tenant prior to completion of the original term of the agreement, tenant shall also be responsible for lost rent, rental commissions, advertising expenses and painting costs necessary to ready premises for re-rental. Landlord may withhold any such amounts from the tenant's security deposit. "
I asked my landlord what the process would be and she mentioned an early termination fee of $500, does this amount need to be stated in the contract? She also said we can advertise for new tenants or they can. We have decided to advertise and know of someone who will be ready to move in and will need to pass credit check. How long can the landlord make us wait for the new tenant to move in?
So:
1. Does the termination fee need to be stated in our contract?
2. How long can the landlord take before allowing new tenants to move in?

If there is no early termination fee in your rental contract then there is no termination fee. If they accept the new renter and the new renter moves in when you move out then you should not have to pay anything.
