Listing Agent won't accept offer
Through my own search I found a house that I liked and contacted the listing agent. She indicated that the fascia boards around the roof needed replacing but she was unaware of any termite damage. When I looked at the house, the damage looked clear to me that it was from termites and had been freshly painted over. This would be a problem with my loaan I assumed, but wanted to put an offer in anyway with the mindset that if it actually was termites, I'd have an out during the inspection.
When we returned to look at the house again, the agent brought her husband who happened to be a mortgage lender despite the fact I told her we already had a mortgage lender. She had no Seller Disclosure despite the fact that I asked her for it twice already at this point. When I told her we wanted to make a formal offer to the seller of $240k (Listed at $280k), she said "No way, that's not what the seller has in mind". I asked her if the seller told her that and she said "I know her mindset very well". Several times I demanded she submit the offer and when I asked her if she was refusing to do so, she stated that I need have my lender provide DU approval. This is when the husband stepped in and says that he can handle it right now if I use him. He told us how he could handle the fascia board repair and get the house termite certified before FHA sees it.
I said "Okay, you do the mortgage and let's submit the offer for $240k." She said the seller's not going to go for $240 and I'm wasting my time.
It was a very strange tag-team, high pressure sales tactic and eventually she had to leave, but the husband stayed and told us to give him our finance info and he'll get setup to have our offer in by the end of the day.
Basically, I don't trust these people farther than I can throw them, but we really like the house. Even if I get her to write up an offer, there's no guarantee that she actually shows the seller. I think part of it is they are trying to hide a termite infestation as well a secure all part of the revenue of the sale.
Is there anything that can be done to either try and get the house or have them reported for what seems like unethical practices in my point of view?

Go find an agent you trust and have them write the offer for you.

I agree, pull some third party to represent you since this lady is not doing her job. A clear conflict directing the mortgage to her husband as well.

Submit a complaint to state board
I would also submit an official complaint to the State Board for Realtors. As others have said, she's broken laws and needs to have her hand slapped to not do it again or her license revoked.

Find a better agent for you instead of being patient with you current one. If the agent does not understand what you want, then it only means the agent is not willing to do the work for your benefit, and only or probably only thinks of his/her own interest.

Sounds like to me if you really want the house you should go a bit higher on your offer. Just a suggestion.

I am constantly amazed that people like this can stay in business!
You should report them immediately and find another reputable realtor to deal with the house sale for you.
Could you trust these people enoughy to have them arrange a mortgage for you that you may be tied into for many years??? NO!
