Finding out Percent Of Ownership???
Hi all,
Well, I own part of a house along with my brother and aunt. So there are three of us on the deed. For some reason all the attorneys we talked to seem to say different things. One says my brother and I own a third and my aunt owns two thirds. The other says we each own a third and my aunt owns a third. Seems that the deeds never said the percent of ownership, so nobody really knows. So my question is, how do I find out what percent of the house I own??? From what I have ready a title search will not tell me percent of ownership as long as its not listed in the deeds. Anyone know what I have to do? I would think logically that there is three people on the deed now, so its everyone gets a third?
Any advice greatlly appreciated,
MJP

Thanks,

I do not know that what is the law apply in your state but i do not think that your aunt may have more than you but its good that you must contact with your lawyer or any expert .

Reading between the lines I would guess you and your Brother own this with your Aunt because you've inherited from one of your parents after they and your Aunt had earlier inherited it from their parents.
If this is the case it is likely you each own 25% and your Aunt 50%. This is because if your grandparents owned 100% then your parent and Aunt inherited 50% each. Therefore you and your Brother would inherit your parent's 50%, so 25% each, while your Aunt would still own 50%.
Is this what has happened?

Hmm. I f you and your brother had inherited the house from your parents, then both of you should have a larger part than your aunt. Also, it depends on how the three of you will agree to each other on how the three of you will share the house and divide it into three. Attorneys only interpret what they think is right on the deed of sale and on the situation, so they might really end up having different results.

Not if your parents along with your aunt had inherited from their parents. Then your aunt and parents would own half each. So inheriting from your parents would mean inheriting their half between you. So you and your Brother would own 50% each of that 50% - so 25% each.
