    Default Limiting the number of units a single renter may occupy

    I am on the board of a condo in NYC. Recently, the sponsor of the building began renting unsold units to a daycare center. As the board, do we have the ability to pass an amendment to limit the total number of units that a single renter may occupy?

    It depends on what is in the condo documents. I would think commercial activity would be restricted unless the development is a mixed used. If commercial activities are allowed then you need to look in your documents to see what your options are.

    Hmm. Well it depends on the rules of the region where you are living at (NYC). You can of course, try to pass an amendment to limit such situation as you have the right as well being a renter. You also have some rights when it comes to renting, as well as the sponsor having limitations as well.
