    Default Contract Assignments

    Can a realtor assign a contract on a home with out violating their brokerage agreement?

    Only the people whose names are on the contract and are a party to the contract can assign the contract.

    On a purchase contract that would be the buyer and seller.

    On a listing agreement it would be the seller and the broker since all listing agreements are in the brokers name with the agent just signing for the broker.

    As for your brokerage agreement, they are all different an no one here can tell you whats on it. Read it and see what it says.

    In the ordinary circumstances a written contract with a Realtor can be any where between 60 to 180 days, depending on the terms of the contract and if the contract was an "Exclusive-Right-To-Sell" in which only the Realtor has the right to sell the property for a commission until the expiration of the contract.
    According to law you can fire a Realtor for non-performing or non-compliance with the terms of the contract, and it must be in writing. And in order to avoid paying a commission to the former Realtor, you should wait for a period of more than 30 days to hire a new Realtor. If there is an actual contract, please try to convince your sister to wait until the expiration of the contract. Wait 30 days or more.

    Well ordinary case Realtor is not allow to breach the contract but if your Realtor and brokerage has mutual agreement then yes he can do.
