    Angry Realtor Failed to Upload Docs for Short Sale

    I know this is a sensitive subject and I am the last person to consider suing someone but my Realtor dropped the ball on the short sale offer that the bank actually accepted. I just found out my home in foreclosure because she failed to upload the correct documents in time. Thank bank sent her a notification of two weeks to correct and she never did. Am I wrong to consider a lawsuit?

    If you have proof of this then sue the crap out of the Real Estate Agent. Make sure that you name the Agent's Broker, the Brokerage firm, and anyone else connected to them in the laswuit! Don't bother going to any Agent Association, licensing board, etc., as the deck is already stacked against you. The only recourse now is to burn them at the stake and collect as much as you can.

    Talk you your Attorney and see if the Attorney thinks going to the newspapers and news stations with your story would help or hurt your case. The more publicity you give the crappy Agent and their Broker the more likely they will settle fast.

    Default Contact the Bank Directly

    Before you consider a lawsuit against your real estate agent you should consider contacting your bank directly to see if you can remedy the situation. Although I understand that you hired a real estate agent to represent you in the sale and short sale negotiation it's important that you keep on top of things as well. It might not be too late to get the bank to stop the foreclosure and review the offer. See what you can get done.

    The reality is that agents can upload the documents numerous times and still the bank can't find them. Ask some agents that do a lot of short sales and you will find that the banks routinely lose their files numerous times and the agents have to start all over again.

    There is a good chance your agent did upload the documents but you were talking to the wrong person at the bank or they lost your file or they just threw it away to lighten your load.

    The banks employees have no motivation to make a short sale work because they get paid just for showing up. Your lost file just made their day easier.

    Your agent has real motivation to make it work. Your agent just went through a lot of work to help you and now they are not getting paid. Point your finger in the right direction.

    Don't automatically blame the agent for a short sale gone bad. If you deal with these things you you will see it looks like the banks are trying to NOT make them work.

    It amazes me how someone can stop paying their mortgage and when they lose their house to foreclosure they blame their agent and want to sue. Thanks for screwing up the real estate market.
