Hello everyone. Well I have a weird situation. I closed on my home 24 hrs ago. When we first went and looked at the house the previous owner had a tenant in there on a month to month lease. Renter was given a 30 day notice that he needed to vacate the premises due to it being sold. He was suppose to be out on June 1st, then June 6th. At the closing yesterday We were told that the tenant has vacated the premises. After signing the all the paper work we had Immediate Possession of the property, we took a drive to the new place and found that the tenant was still living there. He was very surprised to see us show up at the door as we were surprised to see him answer the door. This is my first home as well. The tenant has been notified many times by the realtor/title company that he must vacate the premises immediately even on the day of closing, but it wasnt until after we signed the paperwork. The Man at the title Company assured us that the tenant has vacated. Both the Realtor and Title Company were well aware of the tenant still residing at the home, as of today after speaking with the Realtor and the Man who worked on the title had spoken with him AFTER the closing was done. This is beginning to be a nightmare.. In the paperwork for the House on the Owners Affidavit Paper #11 Reads as follows " I/We are in sole possession of the real estate and no other party has possession, or has right of possession of tenancy, lease or other agreement, written or oral." I am alittle confused on that section. Do we have any sort of recourse against the Realtor/ Title Company / Original Owner for not making sure that their tenant has vacated the premises or are we just stuck with him and have to evict him ourselves? i have spoken with the Realtor today and he told me that i have sole possession of the home and no one is suppose to be residing there and come monday to call the sheriffs department when i head back up. Then I get a call from the man who handled the title work and told me that i would need to evict him. Now clearly someone in this case needs to come to the plate and take up the resposibility as, as stated earlier we were told that the premises was vacant, and clearly the Realtor and Title Company were well aware that the home was not vacant.. Can anyone please help me with some advice on this matter.. Is there any recourse that can be taken against the Realtor and or title Company..I do have voicemails saved from the Realtor stating that the tenant has vacated and the tenant also has saved voicemails from the Title Company and the Realtor stating he needed to be moved out by Noon yesterday..
