Property manager
Hello Pros. I've a question. I own residential hotel currently it's manage by management company. The management company have 2 guys working as hotel manager working under the management company. The 2 guys is our current guest in the hotel. I would like to cut away from the management company and keep the two worker. Will I have problem with management company. I check my contact that I signed with the management company it didn't mention anything about hire their people. It only mention about have to notify them one month ahead of time before cancel. I ask the two manager about if they sign anything with the management company not to work directly with the hotel. They said no. I want to keep them. One sure thing if I stop having management company they will stop hire this 2 managers as well. I just wan to get some advice on what is the best way to approach this situation with out get sue or having the problem with management company later on. Please advice. Thx a lot

If the 2 managers do not have loyalties to the company or anything in their contract regarding working for the hotel without the management company, you should be fine. The management company will probably kick up a fuss so this is where you need to be careful.
Ensure that there is nothing in either on your contracts to state that employees of company cannot work directly for the hotel. Therefore the company would not have anything to argue against.
You will have to go about talking to the managers very carefully to ensure you aren't forcing them to leave the management company but if they enjoy their job I am sure they wioll be happy to stay.

More question
I've talk with management company they will have no problem with it. If I were to hire this 2 managers. I would not like to W2 both of the guys. I would like to have manager number 1 apply for LLC or S-corp business license and have his company 1099 the number 2. In this I take away the money that I have to pay the old management company save some and pay a bit more to number 1 guy whose will become company then have him hire number 2 guy. What do you guy think about this idea ?

You're asking a lot for Manager 1 to open his own corporation and pay the other guy... he would then be responsible for payroll, potentially insurance and so forth...
Can you hire both of them on a 1099 as independent hotel mgmt consultants?
It seems that may be the easiest thing to do.Stirling Gardner
