Expired Contract
The Contract with our real estate agent expired back in June. He has continued to advertise our house and is currently brokering an offer. Are we legally obligated to this agent or can we broker this deal ourselves?

I would say it has allot to do with how you conveyed your intentions with the agent after it expired. Did you convey your interest to sell it on your own, tell him not to show it anymore, or just let things continue as they were while it was listed. There are expressed and implied contracts also not all contracts are in writing. Actions speak louder than words courts will look at that if they can be proved,did he do a diligent job while he had your listing?

expired contract
We actually forgot we had signed a 3 month instead of a 6 month contract. We had kind of given up on the idea of finding a buyer when we got this offer. Upon review of the contract is when we discovered the expiration. In answer to your question, I would have to say yes, he did his side. I don't want to screw this guy, but we were under the impression that we would get alot more movement on this property. I think we are just going to try to renegotiate the contract and maybe get him to lower his commision then use him to negotiate our next purchase. Thanks for the input.

[COLOR=black][FONT=Verdana]If a deal is in works its kind of late to change the rules. No one can guarantee you a specific amount of traffic. But an agent can guarantee to be diligent and market the property to the best of his company

Expired Contract
If the deal he has is a real good one and you want to sell I would probably go with it. Usually though after the contract expires the agent has a protection period you negotiate on but otherwise you would have no obligations to do any business with that agent.
