    Default Bought a pre foreclosure and previous owner refuse to move

    Hello guys,

    I'm in some serious bind here. I closed escrow on a pre foreclosure house in Orange, CA, and as a contingency, the previous owner requested in writing to be given three days to move, which I agreed to. Well it's been three days and they are still there, refusing to move. What are my options at this point? Aren't they considered trespassing?? Can I call the cops to make them move?

    It depends on the document used to let them stay there. If you just let them stay there with nothing in writing, you might have tenants living in your house and you will have to go through the eviction process to get them out.

    Hopefully, you had help with this and you have a short term lease which states how you can get them out.

    Default You need to...

    unfortunately go through the process of eviction.

    Unless your short term lease (that you put in the paperwork for the pre-foreclosure sale) states that they have other rights, you will have to evict them.

    It's not a difficult process, just somewhat challenging if you haven't had to do it before.

    The first place I would start is the California Housing Authority (look up tenant's rights)... it will lead you step by step through the eviction process.
