Thread: eviction

    Default eviction

    I am going to by this house that has been basicly abandon. the x owner can not be served if he can't be found. How long do you have to wait after the eviction before you can take possession of the property inside the house?
    any info would help.

    Default who owns the property?

    Is it a bank? Has it been foreclosed on? Try and contact the bank if there is one or an attorney representing the bank.

    Check the property appraisers website for your area and see if a bank has possession?

    Was it ever listed by a Realtor? If it was they might be able to give you an update.

    I don't know what that has to do with taking possessoin of the contents of a house if the x owner can not be found after a eviction. there is no bank that I can find. the x owner owned that house outright.

    Default Get an attorney and

    have him file papers with the court. You are going to need a judge to sign an order giving you access. There are procedures besides just mailing an owner a letter, that can be implemented legally if the owner can't be located.

    It usually takes 30 days!

    I thought you were buying the property and maybe it was a foreclosure.

    I am going to buy the property and no it is not a foreclosure.
    I am going to buy it through a tax deed sale through the county.
    the owner comes and goes even though the house has been boarded up buy the city. the last time the neighbors saw the owner was about two weeks ago and he went into the house and and then left. nobody knows where he goes. he walks to the bus stop gets on the bus

    Default If the city has boarded up the

    property I am assuming there is no tax certificate held on the property. The court will conduct a tax sale in the city it is located in and you can bid. If you win you will than have access to the property inside.

    You are going to need an attorney to clear the title if you plan on selling after wards.

    Default Have you checked with the county clerk's office

    for the public records of that property? Who the deed was last assigned to?

    The owner does have the right to pay off the tax leins within a certain period of time. Check to make sure you weren't scammed.

    Is there any other way to locate the x owner of the house to sort things out and have a lawyer to deal with the x owner.
