Legal question on using an affiliate network to sell more real estate
I was suggested to repost my message in Legal section, so I am doing so...
Good morning everybody,
I would like to introduce myself and also ask a question.
The bottom line, we provide a unique platform for real estate community to sell properties more efficiently and I would like to ask your advice on how we can be of better service for real estate community.
Introduction:
IdeaMamaAdNetwork.com is the ONLY affiliate network that can run highly priced B2B offers for products with a long sales cycle, such as sales of real estate properties.
Any other ad network can work with you on pay per lead basis only, we can work on pay per sale, and our commission is very low. With over 500,000 affiliates worldwide we can deliver high volume of leads and sales.
We also solicit for you an army of referral partners and resellers who don't have an on-line presence. No other network has an ability to manage off-line relationships. We can, because we have an automated software system that enables referral partners to upload contact information of prospects and monitor the status of the leads, closely watching how they are moving through pipeline. We offer full transparency for affiliates and super-efficiency for advertisers. IdeaMamaAdNetwork.com provides each merchant with a full-blown, proprietary CRM solution to not only manage their channel partners, but also align the business processes of their entire organization - they will get top-rated, award winning sales, marketing and customer support automation solution to serve their new and existing partners and customers.
Question:
From a legal stand point, if our publishers advertise your real estate product on their high-traffic web sites, can you pay them commission form sales they drive? They are obviously not licensed to sell real estate, so how can they go about getting paid on performance? The same question for referral partners of any kind, since our platform, and process help to streamline high volume of referrals.
So, once again. the question is, legally are there any limitations and if there are how would you suggest to go about adopting the process to regulations without loosing the strength of our proposition to you?
I would appreciate if you contact me with any suggestions you might have.
Alex, Biz Dev Manager. My email: sales @ IdeaMamaAdNetwork.com.

I believe the answer to your questions will vary by state. Most real estate law is state specific. If you receive an answer to your questions elsewhere I would appreciate it if you could post the response to this forum. I've thought about a similar compensation strategy for my business.
Looking for a realtor in Minnesota? How about a Missouri realtor in St. Louis or Kansas City? Agents Ranking researches the performance of thousands of real estate agents every year and hand selects the best realtors.
