    Default Ebay/Craigslist Listings

    Another quick legal question. I have some property I want to sell online with ebay or craigslist. I really don't have the time to do it myself and I don't want to sell it through a broker. I have a nephew who has an ebay account and is pretty nifty with computers. I would love for him to be able to take care of it for me, but he is a real estate agent. Would he be in any kind of legal bind if he put it on ebay for me and not listed with his broker? It would advertised as a FSBO and the contacts would be refered back to me.

    I don't think he would be in a legal bind but it would depend on his relationship with his broker. I would suggest he run the scenario by his broker first to make sure he/she doesn't have a problem with it. In real estate full disclosure will take you a long way. I would suggest in his ebay and craigslist postings that he disclose that he is licensed and posting it for a family member. You can utilize his services and if he is willing you can even sign all of the typical listing contracts just don't have him put in on the MLS and list the commission as $0.

    definetly run it by your broker. I wouldn't have a problem with my agents doing this as long as company was not being representing in any shape/form by FSBO.
