    Default Need to change brokers today

    Hi, I am actually writing this for my wife and not sure if this is the correct place to ask the question. My wife is changing brokers and will quit from her office today. She has been an agent for over a year and has been doing well at her office, but her broker gives her no help or support and is in competition with her. She is unhappy and works until 10-11 pm most nights. The other agents and brokers have said not so nice things about the office she works at and have asked my wife to work for them since she is a top producer in our area. She will interview at a few places today, but she has a deal in escrow at the moment and is worried about what she needs to do to finish this deal if she is under another brokerage. Thanks.

    She cannot collect on that deal if she leaves her current brokerage unless she negotiates to still recieve funds from that brokerage. If she chooses to go this route she needs to make the broker put it in writing. All contracts are actually the brokers.

    Umm...not sure with James here. If she gets the deal in escrow and the deal will close, she entitles to her commission even if she's working with another brokerage.
    Changing office is not difficult at all. She's an independant contractor and can work anywhere she wants...

    in most states when you leave a brokerage you leave your listings
    unless the people your working with "decide to cancel there listings"

    The answer to your question is in the independent contractor agreement your wife signed with her broker. If she didn't sign one then she is at the mercy of the broker.

    Make sure she has one with the new company and as with all contracts it is negotiable and this is one of the points she needs to clarify.
