OUR CONSIDERED OPINION ON IMPLEMENTATION OF REAL ESTATE REGULATORY BILL.


1. If the real estate regulator bill is enforced in its right perspective, it will really prove a boon to the home buyers and a bane to the perfidious developers and builders as they will have to clarify all details of a flat being sold viz-a-viz the term of floor area , carpet area, super area, common facilities & common areas etc.

2. Until or unless some impartial politicians and bureaucrats and Builders of repute come forward to streamline the implementation of the real estate regulatory bill, it may not see the light of the day as developers & builders are having a powerful lobby which can influence the law enforcing organs. This fact can be corroborated from all the recent big scams whose big

chunk of amounts have easily been siphoned in the real estate sector.

3. In the present state of affairs, the field of real estate where most of the builders are cheating the innocent buyers in many ways , introduction of real estate Regulatory bill is a must as it will put some pressure on developers / builders not to indulge in malpractices like misuse of client’s construction fund for acquisition of more and more land and delay the construction of sold out projects and unnecessarily harass them in so many other ways like calculation of carpet area , substandard common facilities and use of substandard materials. In view of prevalent malpractices in this field, enforcement of RERB is must to ensure transparent and smooth working of developers / builders but government should also ensure single window clearance & approvals and misuse of any regulation.

4. To avoid over regulation, the real estate regulatory Bill must include all specific guidelines and regulations which protects the interests of home buyers as well smooth completion of projects in time . This can be possible only by enforcing the Real estate Regulatory Act like SEBI, TRAI and IRDA which have really protected the interests of their clients without hampering the operational parameters of the act.
