    Question Who orders the title work?

    I am a Realtor in SC and I have never ordered title work for a real estate transaction but I know other Realtors that do. In SC we use real estate attorneys to close our transactions and they do the title search for the property. I have always felt that it was the banker or mortgage brokers job to order the search and it has never been a problem for me.

    How is everyone else doing this?

    We give our buyers a list of attorneys, pre-screened, and let them pick who handles the closing for them. Some buyers want inexpensive and some want the best.

    It is not a matter of whose job it is. It is about making sure the job gets done professionally while protecting the buyers and ourselves.

    I just email our partner title company and give them the documents if the buyer tells me they want to use them.

    I also notify the listing company with the information.

    Why is it necessary for someone to do the closing and title search? Can't a buyer do it themselves? If the seller and buyer get along real good with each other and all and if the seller never had any problems with the title to begin with, why would the buyer have anything to worry about? ----thanks

    You don't know what it is you don't know. Unless a title search is done by someone authorized by the title insurance company they will not insure the title. Only a fool buys real estate without title insurance.

    How about a bankowned home? Since the bank took possession of the home, isn't the title free and clear?

    The bank will give you a quit claim deed or something similar which only conveys their interest in the property to you. If there is a cloud on the title from 1 or 2 owners ago and you do not have title insurance you will be responsible and liable for any damages.

    If the foreclosed owner did not have a clear title to the property then the bank does not have a clear title to the property.

    Default the attorney

    The attorney will order it. Depending on who give them the contract and deposit fee.
