I think they need prosecute more then they currently do, but that's just my opinion

Exactly. Even flash sites can now be unlocked and their contents duplicated on a different site. Heck you can even allow the same flash movies be automatically fed from the original site to yours.

There is indeed something everyone can do.....
Outdo the thieves by building more backlinks to your content by depriving them the privilege to be listed among the top on the search engines.

Just try to watermark your images with your logo or website. If you're writing articles then place your website name and keywords and make it flow. Your site will rank higher for your search terms and duplicate ones will rank less. And Google will know if your site is being copied and it'll punish them with ranking or even harsh punishment (banned).

with smarter design you can make sure your flash content is running on your domain or it wont run. I think its worse for people to use content on your server because they're getting credit while you're paying for the bandwidth.

Yehp but sadly even then it can still be decompiled with all the tools out there and everything stolen from you bit by bit. It is pretty much impossible to protect your own stuff. Years ago when I was learning web dev stuff I released an _ok_ Flash game on my site. Submitted it to NewGrounds for the publicity and it got to #3. If I google my game, it comes up on 100+ websites before it comes up on mine... ha.
