I had these cases much too often...I only pity those who can't leave because they can't find another apartment anytime soon. The owners can't be blamed as well but they should be responsible and give a head's up to their renters or at least use the rent to payoff the back payments or better yet make an arrangement with the renter and ask if they could help payoff the mortgage and not just keep it a hush hush secret...it will surprise you how many land lords do such a thing for many a reason....

I once saw the tenant removing everything he could in recourse to the notice of auction. It was quite obvious that the owner had nothing more to do with the house and was simply collecting the rent and not making the house payments. He was even smart enough to remove the posted notices before the tenant came home from work. After stopping the last public notice poster from displaying the trustees notice to sell. The tenant took it upon him to remove all the paver stones from all the walk ways, remove the kitchen cabinets and appliances. Remove all the bath trim with plans to sell all of it on Craig’s list and pay for his moving expenses and deposit at the next place.
When I asked the him if he was the owner and he explained to me the situation he also looked into a law suit against the landlord and the lawyer told him that if the Owner is in foreclosure then he is most likely a step away from bankruptcy, he was told that he would have a very good chance of winning a claim but the chances oto collect were nil.
Now I never followed up on this house or the foreclosure of the property. I am sure the owner could have gone after the tenant but most likely he just walked form it and the bank was stuck with a devalued property or some one bought at auction with out the knowledge of the condition of the house.
I can see how this happens a lot and haven’t really thought much about what can be done to help remedy or ease the situation for the tenants?Last edited by RedCarpetSchool; 06-24-2009 at 12:19 AM.
