    Default A subtle deception

    I am being “forced” into closing a purchase of a new construction. I am not happy with the quality of the house (3 separate issues) as well as the representation.

    Let me just make this clear,

    You have not yet given them your deposit? Do you have an agent?

    If you haven't given them any sort of deposit or signed closing documents you can turn away. In addition I would turn away from any transaction where they rushed me to sign documents and did not give me an opportunity to have an agent or attorney present.

    If they haven't completed building what was agreed on prior to going into escrow you may be able to seek damages for them not holding their word. Never let anyone force you into signing something you're not entirely sure of.

    James is right, unless it is in writing you have no recourse. However, if Ryland is leaving I am willing to bet another building is coming in right after them to buy up all their lots. The pools and amenities are usually the developers responsibility. Have you checked with them?

    What happen in case of developer's bankruptcy?

    I have another appointment today (9/29) @ 10:30 to review the corrections. The builder and a home inspector must be there. Anyway, before sign this contract I asked about pool many times. (Because my children asked about pool)
    A salesman told us( my wife and a daughter) that they are going to have a pool by Jun 2009. =====> this is lie. he snareed me.
    I did not sign if i knew that other people going to build a pool instead The Ryland. They never told me about developer before sign.

    If the developer has gone into foreclosure I sincerly doubt that there will ever be a pool.
