Lawn maintenance when renting
"We have a question about our renting a home in Iowa. We moved to Florida and missed our family so moved back to Iowa. We sold our home before we moved to Florida and then sold our home in Florida. We are renting right now until we decide what to do. It has been many years since we have rented. We are renting an up/down duplex. It is an older home (built in 1905). In the lease it states we will do 100% of the lawn maintenance. We are fine with this which we assumed would be mowing, weedeating and pulling some of the weeds. (The yard is huge 2 lots). Our next door neighbor told us he called the landlord about a 20' tree that was hanging over into his yard. The landlord told him that my husband would help him cut it down. He did and of course the 4' tall and 40' x 40' pile is in our yard. My husband told him that he felt it was above and beyond "lawn maintenance" to cut this tree up. He has already worked on it for about 5 hours and probably has
about 10 - 15 minimum hours left. The landlord said "too bad that is part of lawn maintenance". We would like to get an opinion on this. In the lease it states:
RC10B. Landscaping, upkeep and yard maintenance is the responsibility of the tentants in this unit. The standards of which are to be equivilent to or greater than the other properties on the street. This includes lawn, landscaping, deck, sidewalks, driveway and all other areas of the property. In season the lawn must be mowed weekly at a minimum".
Thank you for any help you may give us. We have had just one thing after another and plan on moving out in the spring of 2009." We have had several issues with the landlord from gas leaking, oven not in working condition, furnace not up to par at all, etc. This might be the last straw. Thank you for your opinion
