    Default Realtor did not list "Condo" in MLS Listing - HELP

    Hello! I am a new member here and would like to ask realtors and other specialist in regards to my current situation.

    My mother-in-law bought a new construction Condo at New Smyrna Beach, FL. The realtor that she went with have been unsuccessful in selling the condominium and it has been 6 months now.

    I once met the guy and asked him if the Condo is listed in MLS listing. He said, no it is NOT, he does not list it there for some reason. I read the contract and one of the things indicated there was the home should be listed in MLS listing.

    Now my main question, can you give me a reason why this Realtor does not want to list the Condo in MLS listing ? Is he afraid that other realtors can sell the condo ?

    How bad is it really if the item in not in MLS listing? Is the probability of selling the Condo really decreases.

    Your opinions and suggestions are surely appreciated. Thanks.

    I am not from there, but, generally speaking, if it is nt in the local mls then it might as well not be for sale. This is where agents go to find homes for their buyers. You should get to the bottom of this on her behalf as quickly as possible

    Some reasons the agent may have chosen not to list it is because they do not want to participate in broker reciprocity, or the broker in charge will not let his/her agents participate in broker reciprocity.

    If the contract does state the property will be listed in the MLS and it was not listed there, at the very least it should be grounds to void the contract. Contact the local Association of Realtors to verify this.

    If that is the case and the agent/broker will not rescind the contract you may have to file a complaint.

    There are a lot of agents who may do this in a really hot market so that they don't have to share the commisson with another agent, rather wait till they find their own buyer and get to keep it all.

    Not sure that is the right strategy in this market though!

    If the listing agreement says it is supposed to be in the MLS, I would try to void/ cancel the contract and get another agent...that is if you are serious about selling.

    Or it could be that he simply has not paid his association dues - is there a lock box? Other such signs... I agree there is no reason not to have it listed with MLS -

    To all.
    Thank you for all your comments and suggestions.

    Yes, we are very serious in selling this condiminium. To honest, it has been tough because they have been paying two mortgages lately. Instead of having this place as an investment, it has been more of a burden.

    I will print all your suggestions and give it to my mother-in-law. Any other suggestions would be great.

    One more thing, do you know anyone in the New Smyrna beach, FL area that would be a good realtor for condominiums.

    Should I go with bigger companies such as Century 21, Real Max, etc. ? Would that help sell the condominium better ?
