    Default Listing Termination Question

    I have a condo listed for sale with a realty group LLC. We're about half way through the six month term, with no offers yet. I've read every word of the listing contract and there is nothing in it describing the circumstances under which the contract might be terminated early, by either party. No 30 day written notice requirement, or anything like that. It does not even contain language requiring payment of the commission if I withdraw the property from the market before the term expires. The agreement is between me as seller and a real estate group LLC. It was accepted (signed) by my realtor, acting as Broker on behalf of the LLC. He called me yesterday to tell me he is no longer affiliated with the LLC in any capacity and can no longer handle my transaction as the listing agreement remains the property of the LLC. He stated that the group will assign a different agent to handle my listing from this point forward. I'm not happy with this situation and would not have listed with this group if the realtor (my friend and neighbor) had not been involved. Given all the above, can I terminate this contract without becoming obligated to pay the commission? If so, how?

    All you can do is ask the broker in charge if you can cancel the listings because you would like to list it with your friend. If they are smart they will let you go.

    If the broker says yes then get it in writing before you list with your friend.

    That would be a good reason for the broker in charge to release you from the contract,
    no reason to bind you if your not satisfied.
