    Default Buying a house and the septic drains into the creek?

    OK I am buying a home in St Clair county Michigan and I noticed the septic drains into a creek that runs behind the house. Now I know this is highly illegal and needs to be fixed. Who pays? It is illegal, what part do the Realtors play knowing its illegal? Can the sale even happen being illegal?

    Hi Vender!

    Firstly, everything is fixable. The roles of the agents if they are Realtors is to owe all parties involved fair and honest dealings and to disclose any material facts adversely affecting the property. That's why we encourage buyers to get a full inspection of the home. If it's an acreage property then wells and septic systems need to be checked.
    Sounds like a failed septic drain field, have it evaluated by a professional.

    This is the problem if I have it inspected it will be reported to the county and shut down until repaired, which is great for me. But this couple are awesome and I dont want to be the bad guy. I guess I will just talked to the owners and see what we can work out. My thing is that if we dont buy it the owners will then HAVE to fix it. We are buying it no matter what. everything can be fixed is right and this house is literally one in a million. It may even have historical value I still need to check.

    What kind of "deals" do realtors see happening in this kind of case? Have the sellers fix it? Ask for cash? do the sellers have to do anything?

    If you are still in your inspection period then try to negotiate. It can't hurt and you never know until you try. I don't know the laws in your state. In MA we have something called Title V that septic systems have to pass. Other states do not have laws like this so the buyer really needs to be prudent and inspect these issue during the home inspection period and then negotiate any issues that come or decide from there if they want to back out of the deal due to inspection issues.

    Yes, the sale can occur with an illegal septic disposal and the problem will then be your problem.

    The fix could get very expensive so make sure you get it fixed before you buy it. To get it fixed the authorities will have to be notified so don't wait until it is too late.
