How possible is it to revert commercial property back to agricultural?
I have my eye on a property. It was a low land area next to a creek. It was in a flood plain. The owner owned a dirt hauling company. He used the place as a dump for dirt, rock and concrete. That use brought it up out of the flood plain and so now the city thinks it is commercial property and tagged it as such...but yet the title says "ground infirma" on it, which means infiurm ground, which means you can't pour concrete on it and build a building...in my opinion...unless you dig down 15 or more feet to the subserface and put in piers.
So my question is...how possible is it to revert this land back to agricultural use since it is basically useless? I only want to know how I can revert it back to aggricultural use, and what my arguement could be. Thanks.

The current owner was probably the one to have it changed to commercial to raise the value. You will have to go to the taxing authority to get the zoning changed which they will be reluctant to do because it is now generating more tax income. Usually, only the owner can get the zoning changed.
Did the owner need or have the permits to fill in an area so close to the water? This is where Army Corp of Engineers shows up and determines that wetlands was filled illegally and requires the current owner, whether they did the filing or not, to remove the fill and return the land to wetlands and pay fines.Your Outer Banks real estate agent.
