    Default Early Termination Fee

    hello. i lease my apartment and the lease is going to expire in december. but i need to leave the apartment in august cause need to leave the country. well,there is a early termination clause in contract which explains need to pay early termination fee which equal to two months rent. when i signed the contract i paid first and last month rent plus deposit. i wonder do i still have to pay early termination fee ? will i get my last month rent and deposit back? can we think last month and deposit in exchange for ealy termination fee

    If the contract says you will need to pay for two month then you will have to pay for two months. re-read the contract regarding the last months payment and if it can be used as one of the months.

    im so aware of that. the thing is i'm ok to pay two months rent... are they going to pay my last month rent and deposit? does it make sense?

    so it's going to be equal. can i just leave my last month and deposit ?

    If you've entered into a one- or two-year contract and choose to terminate or cancel your service before your contract ends, you will be charged an early termination fee of up to $200 per line unless otherwise eligible under the 30-day guarantee period.

    in the contract says

    i agree as provoided in the rental agreement to pay 2600 $ (an amount does not exceed to months rent) as liquiated damages or an early termination fee if i elect to terminate the rental agreement and the landlord waives to right to seek additional rent beyond the month and which the landlord retakes possesion

    i'm moving out of country.. means they don't have any chances to pay me my advance last month and deposit later on.

    so can i offer them to keep my advance last month rent and deposit as early termination fee ?
