    Default illegal unit

    i am in california. I am trying to buy a house with an illegal unit... the gargage was turned into a living room and attach to the garage they added a kitchet and a large bedroom what i was wondering , i submited an offer, they ask for counter offer, i submitted another offer and they accepted... they said i have 10 days to decide.

    1. is it possible for me to convert the illegal unit into a legal unit and if so what is the process?
    2. do i have to tear down the illegal unit?
    3. i am also worried about my deposit.. if it goes to escrow and the loan doesnt get approved because of the illegal unit will i get my money back..

    Best rule of thumb! Anything with illegal is a bad idea. Before you hand over the money and sign anything, you should inquire with the housing council of the area about the legal implications of buying a house with an existing illegal structure. If the liabilities and legal costs outweigh what you will pay for the house, find another property instead.

    realestategirl has it right. Talk to the local authorities who handle the building permits and zoning issues. Ask lots of questions.

    If the area is zoned single family then the apartment might have to go.

    If the work was not done up to code then it might have to be brought up to code. ie new wiring, plumbing etc.

    Yeah right, finding a better property is the best thing to do.. With no illegal units..
    Find the best high rise condominiums with a monthly guaranteed rental income only at Lancaster Atrium.

    Be patient and wait for the housing committees advice in this. You will probably get any deposit back in full, and maybe any rent you've paid to this landlord. If it's an illegal unit, your lease contract will be void.
