    Default living on in-laws land

    my in-laws own 6 acres of land. my singlewide is on 1 of these acres. can this acre be divided off separately & purchased by me? there is $38,000 owed on the 6 acres.

    Actually, there are a couple of things which could get in the way.

    1.The zoning regulations for the area might have restrictions on the size of lots. We have an area where lots have a minimum size of 10,000sf.

    2.The lender is not going to want the property divided unless the loan is paid off. If you sub-divide the land and they find out the lender might enforce the due on sale clause and if your in-laws don't have the money to pay it off then the bank can foreclose and take back the whole property, including your piece.

    You need to find out what the zoning is on the property to determine that. If it is zoned R5 then no you would not be able to. If it were zoned R1 then yes. Chances are that it is zoned R5, R10 or F1. In which case you will be out of luck. Check with the county land records office.
