How can I have the broker terminate the listing agreement
My listing agent left the company. I want to terminate the listings with his old broker. But his old broker did not coporate. I have no written listing agreement with the broker. How can I have the broker sign the terminate of listing form so I can find a new agent.

Terminating a Listing Agreement
First,
Ask the broker for a copy of the listing agreement. Second Review the agreement to see what are the potential reasons for termination. There may be something in the agreement which allows you to terminate the listing before it expires.
If he doesn't give you a copy of the agreement to review, go ahead and submit a termination letter. For them to deny your termination, they would need to provide a copy of the listing contract which would then allow you to receive a copy of the agreement to review.

Also the internet is a pwerful tool.
If the broker is unwilling to cooperate I would make his unprofessionalism know to all by posting negative reviews, posts, and ads. Negative publicity might light a fire under his *** to get you what you want.
Any broker that is worth 2 cents in this industry will never try to force a listing agreement unless they have already done all of their work and found a buyer already etc.Best Regards,

Thanks everybody. I called them, they told me that it is the salesperson who put it on the MLS. It is his listing, so that he has to remove it. He has to sign. I have the salesperson signed, but the form said that the broker associate has to sign. I ask them to sign one more time and get refused again.
What he told me is right? The HAR told me that the broker has to sign.

In my state your contract is with the Principal Broker of the company not your agent.
If you read your listing you will probably find that it is not a contract with the listing agent, but his company at the time. You will need to talk to the Principal Broker at that company. No one can force you to sell, but they can hold you to the terms of the listing. This may not be true in your area. However, it is common in my area for brokerages to allow listings to move companies with their listing agents if the client wants that, usually with that agent paying a % of commission to them.
