    Unhappy My old broker did not terminate the listing

    I transfer company, my old broker did not terminate the listing on MLS with my seller. We do not have wrtten listing contract.
    My client got very upset. What should I/He do to let the broker sign the termination of listing contract.

    The listing agreement is between your broker and the seller. If you did not have an agreement with your broker about how this would be handled prior to leaving the company then there is nothing you can do now.

    If you talk to the seller about canceling the listing with your ex broker and listing with you then you are breaking civil laws by tortuously interfering with a contract and you are also breaking the realtor code of ethics by soliciting the active listing of another realtor.

    I did not tell my seller to cancel the listing. Just my seller is upset and do not know what to do. He does not want to work with people that he did not know.He is upset that I did not handle it before I leave.

    I keep reading all over this forum that people DON'T have written listing agreements?! Is this common i sother parts of the country?? In Nevada we NEVER take a listing without a written listing agreement.

    Default Speak with your old broker

    Ask them to release the listing to you. I doubt they would want to deal with a listing where the seller doesn't want to work with them anyways. It wouldn't be a bad idea for the seller to contact them as well.

    Are you asking about the removal of the MLS posting? If there is no active written Listing agreement between the Seller and the Broker, and all you're looking to do is remove the MLS post that resulted from a Now Expired agreement but, failed to be removed, then it's no big deal. Have your Seller request for it to be removed by your ex-Broker. No reason why he/she would want to continue to have it listed on the MLS when he/she has no further interest in the sale. If there IS a written Listing Agreement, request a cancellation or wait for it to expire. The Broker shouldn't have a problem canceling this type of agreement. I'm sure you can find a remedy to this situation through effective communication. Good Luck !

    we NEVER take a listing without a written listing agreement.
    This is somewhat confusing! I,also won't take any listing without agreement!

    Why does anyone list a home without a written listing agreement?

    It's the law here in Oklahoma. Do your best to work out the situation, but always have a written agreement from here on out.
