    Default New Construction Residential Agreement & Joint Escrow Instructions

    What documents the Seller MUST present, when buying new construction before my offer?
    I got sent only the New Construction Residential Agreement & Joint Escrow Instructions.
    The property is a mix use commercial/residential, the residential part is a condominiums on top of the commercial part.
    I have requested from the seller the following documents:

    - Final Subdivision Public Report
    - Receipt for Public Report
    - Articles of Incorporation
    - Bylaws
    - CC&R's - recorded - You sent this!
    - Condominium Plan - recorded
    - Budget - commercial
    - Budget - joint - You sent this!
    - Budget - residential
    - New Construction Residential Purchase Agreement & Joint Escrow Instructions
    - New Construction Addendum To RPA-CA
    - New Construction Notice Of Completion & Notice to Close Escrow
    - Disclosure Statement
    - New Construction Property Disclosure Statement
    - Disclosure Regarding Real Estate Agency Relationship
    - Construction Claims Statute or SB800
    - Buyer's inspection Advisory
    - Market Conditions Advisory
    - Amenities List
    - Water Heater & Smoke Detector Statement of Compliance
    - Megan's Law Data Base Disclosure

    Also I requested the Certificate of occupancy.

    Should I mandatorilly use the form provided from the Sellers agent?

    It sounds like you are an agent so I am going to write my response accordingly.

    Some of these forms are to be generated by the buyers agent which would be you. If you don't know which forms to use you really need to be talking to your broker before you make a costly mistake. It sounds like you are in way over your head.

    Talk to your broker that is what they are there for.
