    Default Home Selling with or without Agent

    My sister might buy a house that I own. She wants to contact a real estate agent to check a few other homes since she may want to buy a bigger home. If she decides to purchase my home, I would like to sell it 'For Sale by Owner'. Is there a conflict for the agent?

    There won't be any conflict if your home isn't listed with an agency. Any agency.
    If it's not listed, there's no conflict.

    If you do list it with an agency and sell it on your own, be sure to read the agency contract first before you sign it as an Exclusive contract basically states you owe the agency their fee, even if you found a buyer on your own.

    Make sure your sister does not sign an exclusive buyer agency agreement with the agent who shows her houses.

    If she signs one and then buys your house she might be obligated to pay the agent a commission on your house.

    My home will not be listed with any agency.

    Are buyer agency agreements commonly used? She knows someone who is an real estate agent, so I will inform her not to sign one.

    If your home is not listed with any agency then there should not be any conflict I guess. Ask her to go through the contract details and fine prints properly if she signs any.

    Always check the contract. If she signs one, look into the provisions if it is exclusive or not. Most contracts have this for sure. You can also contact the agency and make some arrangements.
