Default Do we still qualify for the $8000 tax credit?

My fiancee and I made an offer on a house such that the owners agreed upon the price. However, they were deliquent on their payments and had just notified the bank with a letter of hardship (short-sale). We signed a Purchase & Sales in February, 2010 and just recently, we were notified that the sellers attourney has spoken with the bank and it looks like the decision will be in our favor.

Does anyone have an understanding with the first time homebuyers $8000 tax credit that ended 4/30? Would it still qualify for us seeing how we signed a contract in February, 2010?

    Thanks

If you had the Purchase offer accepted by the seller by 4/30, you may still be in the running.
