    Default Possible Shady Seller

    My wife and I closed on our first house on 5/14. We were very excited and love the house. There is a problem that just came up today however that has me a bit frustrated. When we were under contract, we had an HVAC company come out to inspect the duct work and system. It was determined that repair work was needed. We gave the seller the list of items to be completed, and upon closing, she gave us the invoice for the work she had completed. Well, when we got into the house after closing, we noticed the AC unit wasnt really pushing much air out. I called the HVAC company that she used and had them come out again. The technician let me know that the work was not done properly the first time, and that he needed to so a little extra cleaning. He said since their last visit was just 2 weeks earlier, there would be no charge. So we had moved on until the other day when I got a bill from that HVAC company. When I called to complain, they told me it was because they had NO record of ever sending a technician to the house for the first visit. The invoice also doesnt not have any name on it for who performed the work. All it has is what was "completed" and that the seller paid by check. So while we are still in a "discovery" phase for what took place, all signs are indicating the seller found someone who possible used to work for the HVAC company, still had their invoices, and did the work for her on the cheap, just so she could show she did it.

    What is my recourse if we find out this is indeed what the seller did? My real estate agent has contacted the sellers realtor to get a copy of the cancelled check to see who it was made out too, so we can send that information to the HVAC company, but what next? I clearly dont trust anything she has done for that house now!

    It sounds like that is your only recourse. And the former owner by the way isn't obligated in any way to hand over cancelled checks to anyone. I believe that right is guaranteed in the Fourth Amendment.

    From what you wrote here it sounds like the HVAC company is the one who is not telling the truth.

    Is the problem fixed and how much did it cost?
