    Default agent enters house when I denied visit!!

    The potential buyers' agent was denied an entry into my house. I have confirmation from the calling agency that the visit denied.

    The potential buyers’ agent knocked on my door and my figured no one was home, so she entered the house with the glass repairman. I even had the storm door chained so it only opened about 6 inches which would make it harder to get to the lock box. She was able to get the key out of the lockbox and enter my house through the back door. Her claim is she called the showing to see if she could come into my house and did not receive a call that she could not come in until after she was in the house. I FIND THS INTERSTING! SHE HAD NO RIGHT TO BE IN MY HOUSE WITHOUT MY PERMISSION AND DID NOT HAVE MY PERMISSION TO BE IN MY HOUSE IN THE FIRST PLACE!!!!!!!

    Now the reason she entered my house: Her clients are getting a FHA loan, if we decide to fix what is required. The FHA appraiser reported we had to replace one window, check a window in the master bathroom, and were missing and had to replace 8 screens (and by the way - we had 11 screens out - all the screen were new - we just were waiting to put them in so the would not get damaged by the pine trees. So which of the 8 of the 11 screen do we replace?). The appraiser form did not say which window was to be replaced and did not say what window in the bathroom that had to be checked as there are two. But the agent knew which window it was and took a glass specialist to get an estimate on repair. Neither my husband nor I have agreed to fix any of the FHA repairs. We have been waiting on further information on especially what has to be fixed for requirements.

    I did, however, give the agent permission to go on my property and look at the window for the outside. The next day after this agent illegally entered my home, I received a statement from the glass company on the cost of repairs and replacements. After speaking with my agent, I got the idea that the buyers’ agent entered my home. I did not find out for sure until she sent the following letter.

    This an apology letter:

    My humble apologies for the confusion about entering your home last Thursday. I instructed the glass professional to drop by the house to measure the windows from the outside. In order to get the correct measurements to order the window and replace them in a timely manner so we can close on time, he would have to measure from inside.

    I went back over to the house with him and knocked on the door and found no one home. I had called Centralized Showing Service (CSS) to let them know that I was entering the home. We entered home with key from lockbox and did notice that the chain was attached on top of storm door. After we had been in home for 5 minutes, CSS called to tell me that the lockbox had been removed from house. I was a bit confused since it was on the door.

    I hope you will accept my apology and understand the timeliness of this situation
    .

    So the buyers' agent enters my house with a man form a glass company to get us an estimate on how much it will cost for US to replace and fix the windows. Again we have not agreed to fix anything and she was denied access to come in my house. So should I be upset? My agent thinks she did nothing wrong. By the way, she also damaged my storm door as it does not close properly. I have not filed charges and probably will not, but did file a police report. Am I wrong to be upset????? I had the lockbox removed and my agent has yet to give me information on the box

    Hi,

    How is that possible?I mean it is really very bad that after you denied and they entered in the house but you have taken a right action by having the apology later.

    If I was the agent, regardless of how proactive I would like to be, I wouldn't have entered until I received confirmation that it was approved (liability issues). That's not to say she was wrong, but not something I would have done. I think the apology letter seemed sincere and, as the seller, I would have been satisfied with that. Was a police report necessary? Only if you felt it was (although I wouldn't have wanted to be the officer responding). My advice, let it go and see that the transaction goes through.     Yes, you are a little bent out of shape, but she was just doing what she thought was necessary to get the deal to the closing table. Certainly she was not trying to cause any trouble. Don't worry about your screen door, it will soon belong to someone else. Try to think of this as a business transaction and remove as much emotion as you possibly can and you'll feel much better.

    Our listing agreements and the sales contract both stipulate that the seller has to allow access to these types of repair men. If this deal falls through because of your lack of cooperation you might still owe the listing agent a commission.

    Read the 2 contracts you signed to see if you have any say in this and what your liabilities are. Once you sign a contract you are obligated to follow it.

    The letter seems sincere enough. I realize she should not have entered without confirmation but it does not appear that she had any ill intentions.
