questions on buying a home in Upstate New York
Hi! So happy to find this site. I've had these questions without a good place to ask until now.
Have to start with my situation, in brief. My beloved husband has advanced pancreatic cancer. He doesn't have long to live. He has only one request, and that is to move back to NY from northern New England for two reasons: to be near family and friends, and to be sure I'm going to be okay.
So we flew down a month ago, looked at houses, made an offer that was accepted. I made sure all parties were well aware that we had to move into the house in April, preferably on the first. The seller (a bank) couldn't do the 1st, so agreed to close "by" the 15th. It's April 5th, and I still don't have a closing date. I call our lawyer every day, and get " we'll call you tomorrow." I spoke with our realtor and she said it's the way it is in NY because it's a "lawyer state."
We are paying cash for the house, no lender involved except through the seller. I'm trying to keep movers working with me, with no confirmed date. I have to get hospice and doctors arranged well before the move (they're notified but can't do anything without dates). I'm getting ready to tear my hair out trying to deal with everything. The lady at the lawyers office today said that our lawyer reviewed the title search and had notes she had to follow up on. I've told her the whole situation, and I'm sure she's sick of me, but I'm sick of the situation.
Does anyone have ANY advice besides be patient?

So let me see if I understand correctly, this is an REO property, correct? If so, banks have a way of imposing their own rules even at times when it doesn't make sense. But from what I have experienced here, banks want to move REO's quickly, so the fact that a closing date has not been established can be quite unsettling. Has your Realtor given you any input/direction as to why closing has not been scheduled? Can you be more specific as to where in the process you are? Have you had an inspection yet? I assume escrow has been opened, am I correct? Perhaps NY real estate agents will chime in with local advice.

Find out some property portals in your area and see what people say about this REO property its terms & condition and what ever stuff it require to buy house. It is one of the best solution in your case you will find all the answers over their.

When we put in the offer on the house, we were under the impression that the owner was selling in pre-foreclosure. She accepted the offer, and the first bank would be paid in full. So all was well, when a few days later we found out she neglected to mention a 2nd mortgage. So we started house hunting again, until we got a call a few days later that the 2nd bank would accept the offer and expedite the sale. We took it.
As far as where we are in the process: the survey is complete, the title search is done, but our lawyer had questions to be resolved (by today, supposedly). The money to pay for the house and closing costs is being held by our attorney. Since we aren't getting a mortgage, I have no idea what else needs to be done. We didn't use a formal home inspection (a relative is a licensed inspector and did check out the place for us, thoroughly).
I'm just so frustrated!!
