    Default Repairing home that is not your, Yet

    I am a little confused. My loan is still at underwriting. My realtor informed me to repair the home so my loan can close. Okay. he sent me an email to repair home and everything is okay. We go in and take everything off and there are lots more problems. We get call from realtor saying that he did not get permission from seller or owner to start any repairs. That the background. my question is he never negioation with the seller which is a bank owned properties for any repairs. he is embrass to go back now because the repair have been started and is not sure what happenning? As a buyer i have a right to negiotation he is refusing? what happen is the loan does not go thru. I am out 5,000 in repairs.

    There is always a risk to do repairs to a home you do not own. It is not advisable to ever do this without written permission from the seller. Even if the seller is ok with this, you are still at risk should the transaction not go through. I am only an agent and not an attorney, so my advice would be to contact the broker of the agent you are working with to discuss the situation with him/her.

    I totally agree with Dan. You need to contact the agent's broker and ask him/her to step in and help you immediately. Your agent should have warned you about the risks of making repairs prior to closing, and definitely should not have suggested it at all without getting permission from the seller first.

    Never spend money on something you do not own unless it is for charity.

    Your agent was way out of line when they told you to do repairs. Just because it is bank owned does not mean the bank/seller would not have done the repairs. You should have asked the bank to do the repairs first.

    Unless there is a stipulation about repairs, I would also not advise any repairs done to a property that is still under negotiation.

    Legally, you cannot ask for the refund of whatever you have spent on the repairs.

    It's still best to consult a lawyer on this matter.

    Your agent should have known better, he/she should have never told you to start repairs on a property thats not yours.... thats crazy! You need to get the agents broker involved asap and get your money back.... hopefully your loan closes.

    Yes,repairs are always a risk for real state industry. Everything must be set up first before starting the desired repairs. Incase of problems, it is best to have a written documentation that you are permitted to do repairs to avoid any questions and to be sure to avoid problems regarding miscommunications like of verbal approach.
