    Default Refused to sell

    I accepted a offer to sell a house i owned in march 2009, in april 2009 , about 2 weeks away from closing i decided i did not want to sell the house , my wife who also owns the house was aware and willing to sell but never signed the purchase offer, to day got a letter from the buyers lawyer stating i had 5 days to pay them $43,000.00 or they would sue me for it . They already bought another home for $21,000 more then they offerd to buy mine for .

    Sounds like you dug yourself a hole. You definitely need a layer for this one because depending on where you are and what your contract says, you might owe them some money.

    If I was your listing agent, you would owe me a commission for fulfilling my half of the contract.

    First, you had a contract which you wife is an owner and she did not sign??
    Normally buyers can sue the sellers for specific preformance if they try to back out of the contact. Seeing that you wife didn't sign they probably can't sue to get the home (althought they bought one anyway).
    It does sound you made some fradulent claims without making your wife aware (you claim she was aware) and/or sign or if she did not want to sell and you let the buyers believe they had a contract.
    Yeah, sounds like you screwed yourself. Get a lawyer!

    You definitely need a lawyer on this one. Even though your wife did not sign the contract, the fact that you did and I am guessing you went along with the inspections etc. could mean an implied contract.

    Oh my, sounds like a bit of a predicament.This is definitely a case for a good real estate attorney. Do not try to handle this one on your own.
