    my, sister is co-owner to a property that me and my mother brought, she took all our money and rents the property out, against what we wanted, and is collecting rent money, money on which my mother who is 80yrs needs to pay her bills, My sister is already in a well to do neighborhood, in the ball park of $1,000,00 to $3,000,000.

    we sent her money for repairs, and she did call and have me go sign for a loan, on which she said that if we get, she will send me half to cover the mortgage and to continue to fix up homes, a week later I ask if we got the loan, she said we did not, this was two year into purchasing the property, upon lie after lie, so now i go to the records of deeds and it says she did get a loan for $75,000 dollars, I call her and tell her to sale that property, I called a real estate agent, who went and checked out the property. He informed me that hardly no work was done to this property, and that even tho we sent $97.000 to purchase the property, (with closing cost of $5,000) the property is only worth $83,000 dollars.

    The money we sent to my sister was money saved from both me and my mothers accounts, my severance package money and pension after being laid off.

    My sister ask if she could help us, with our real estate business, and make money too, we were under the impression that she would be using some of her money as well, it turns out we were spending all our money. When the mortgage bill was due, she cast me a death hear, hoping that my mother would lose her home, so that she could come and purchase it for that loan amount. I told her this bill was due, she said for me to get a job, and that my our mother can use her social security money to pay the bills.

    This sister has never been abused or anything, and made well in her life, on which we used to brag about her.

    The property was bought to fix up an sale (with no money of my sister) so that I could buy my mother a new home, instead my sister took the money and took a loan out on the property...oh its to much to write, years of work, and my sister just dose not care, she talks with my mother on the phone telling her of the vacations and nice places shes going.

    Oh yes, upon me being laid off, included in that money was my severance package money and my pension.

    It's been three years, and nothing.

    Can someone give me some advice, on how to place a lien on her property, or can I sale my part of that property, then with the half that she has place a lien on that. She has also taken a loan out on this property, so if I should sale my half, will that loan be my responsibility. We let her put her name on the deed not thinking she would do this. Since she already has money.

    The best advice for this situation is to consult a lawyer. A great lawyer will be able to sort out the flow of money and make sure everyone gets her fair share. The first approach by the lawyer would be to get any money due to you back from your sister. It is going to be difficult to prove if there is no contract or agreement in place but gather any documents that you can find including emails showing the nature of your agreement. Once the documents have been gathered your lawyer will present a case to the court in order to get your sister to pay what is owed. If she fails to pay the court can force the sale of the home with the proceeds of the sale first going to you and your mother to cover what you are owed.
