My real estate agent should normally get 2.5% and the buyer agent 2.5%. If the buyer has no agent, then my RE agent should get 3%. Simple? Not really. We have found a buyer with no agent until today! My agent now claims that the buyer contacted his associate first who now became the buyer agent! Therefore they want all the 5% in the same office. That seems against the law to me, especially because this associate has always dealt with us as well. If someone can indicate to me what RE law article I should consult, I want to the rescind the contract with my RE agent ASAP.

This doesn't make sense to me. When I take a listing I contract for 6%. If I found the buyer then I will take the full 6%, if someone else found the buyer they will get 3% and I will get 3%. Simple.
However, I usually have an addendum to the listing agreement stating that if I find the buyer for my listing then the total commissions will be 5%, basically giving the seller a 1% discount.
So unless you have an addendum to your listing contract stating that you will recieve a 2% discount if the buyer is found by your listing agent or any other agent in that office everything seems legal to me.
