During February of 2005, my wife and her four (adult) siblings inherited a single family home located in Massachusetts as tenants-in-common with equal shares. Several years earlier we had expressed interest in the property and subsequently were approached to buy after the unfortunate passing. One of the siblings has been, and remains, living on the premises and refuses to sign a Purchase and Sale agreement. We have offered a couple of different scenarios in vain. He argues that since he was living there with his mom for quite some time, he feels the property should have been given to him solely, and therefore has no intention of moving, buying, nor selling. He just wants things to remain the same (as is).

What recourse(s) are there?
