Several months ago we represented a tenant who was renting a home in Weston, Florida. The lease is for a 12 month period. The tenant pays the landlord $1900 per month to reside in the landlords home.
Yesterday afternoon our client came home from lunch and got visibly shaken the Realtor for the landlord and her prospective Buyer were inside the tenants home looking around.There was never any notice that the landlord had placed the home "For Sale" and clearly the Realtor and Landlord violated the Tenant/Landlord Rights.
Our client called us hysterical, she was crying and felt violated and truthfully I couldn`t blame her! I`d be shaken too!
I decided to call the Realtor to find out what the heck is going on!
The conversation is as follows:
Me: There must be some confusion, the tenant has a one year lease and there are 7 months remaining on that lease. You also need permission from the tenant to show this home, you can`t just walk in unannounced! You do understand Tenant /Landlord rights.
Confused Realtor: What??! We can sell this house anytime we want, the tenant will have too move out! The landlord can sell their home and the tenant can`t do a thing!
Me: Really? The tenant is paying the landlord rent! The tenant has rights and yes you can sell this house, but the new buyer must continue with the lease.
Confused Realtor: There is no such thing as tenant/landlord rights! The landlord does what he wants, in Columbia we do it all the time!!!
Me: This isn`t Columbia and you better speak to you`re Broker and wake up! This is the United States and the tenant has rights! You better make sure you`re practicing Real Estate in the US? My GOD!
Here lies the problem in South Florida. In another country the laws are quite different than our rules and yet, some Realtors believe what applies in another country is the same!
We called this agents broker read them the "Riot" act,the Broker we apologizing up and down.
He assured us that he`ll speak to his Realtor and make sure that she understands the laws as well.
It`s hard to believe this could happen!
