I am selling my family's farm in a rural part of another state and have the names of 4 or 5 locals that I know are interested in the property for farming. It is just over 700 acres and located within a few miles of a major interstate highway and could be potenitially developed into something other than farm land. I am thinking of hiring a broker/professional that could market to companies or individuals that would want it for something other than farming and probably willing to pay more.

My question is this: Can I hire a broker and tell them that I have already been contacted by these various farmers and that we will only pay them a commision if we decide to sell to a buyer that they find? Why should we pay them a fee to sell it to someone that would have bought it anyway without their help? Thanks in advance for your valuable advice!!!!!!!!!

The answer to your question is yes. When you sign the listing agreement make sure the other peoples names are on the listing agreement as excluded from commission.

Don't expect your realtor to go all out for you though when you have back door deals with no commission out there.

Research your state laws of "agency relationships" and find out for yourself what zoning is permittable for that property. It helps to [know] what you are selling before a broker comes along and takes advantage of you.

You can hire a broker to advertise,market your property/listing and be the facilitator in these transaction. There are ways to modify and ammend these contracts but again, it really depends on your state laws first.
